Who Pays for Space Debris? Applying the Polluter Pays Principle Beyond Earth

Look up at the night sky and you'll see stars. What you won't see is the junk: thousands of dead satellites, spent rocket stages, and stray bolts and paint flecks, all zipping around the Earth at speeds fast enough to turn a fleck of metal into a bullet. This is space debris, and it's becoming one of the quiet crises of our time.

On Earth, when a factory dumps waste into a river, we have a simple, powerful idea to deal with it: the polluter should pay. It's called the "Polluter Pays Principle," and it says that whoever creates pollution should bear the cost of cleaning it up or preventing the harm in the first place. The question worth asking is simple: why doesn't this idea apply to outer space?

The Junkyard Above Us

Since Sputnik went up in 1957, humans have launched thousands of objects into orbit. Many of them are still there, long after they stopped working. Old satellites, broken solar panels, and pieces of rockets now circle the planet, some of them for decades or even centuries before they'll naturally fall back and burn up.

The danger isn't just clutter. These objects travel at incredible speeds, around 28,000 kilometers per hour in low Earth orbit. At that speed, even a small piece of debris can destroy a working satellite on impact. This isn't hypothetical either. In 2009, a defunct Russian military satellite called Cosmos 2251 collided with a working American communications satellite, Iridium 33, destroying both and scattering thousands of new fragments across low Earth orbit. It was the first major satellite to satellite collision in history, and a preview of what happens when debris is left unmanaged. Two years earlier, in 2007, China deliberately destroyed one of its own defunct weather satellites in an anti-satellite missile test, creating one of the largest single debris clouds ever recorded, much of which is still in orbit today.

And every collision creates more debris, which can go on to cause more collisions. Scientists have a name for this domino effect: the Kessler Syndrome. In the worst case, certain orbits could become so cluttered with debris that they become unusable for generations.

This isn't a distant, abstract problem either. Satellites are part of everyday life now: GPS, weather forecasting, phone signals, internet access, banking systems, and even farming all rely on them. If space becomes too dangerous to operate in, life on Earth feels it too.

 

Why "Polluter Pays" Makes Sense Here

The Polluter Pays Principle grew out of environmental law on Earth. It rests on a fairly commonsense idea: if your activity creates a cost for society, that cost shouldn't be dumped onto everyone else. You should pay for the mess your business creates, whether that's carbon emissions, chemical waste, or oil spills.

Space debris fits this logic almost perfectly. Every satellite launched is a business decision, usually made by governments or private companies chasing profit, prestige, or strategic advantage. But when that satellite dies and becomes debris, the risk it now poses is shared by everyone who uses space, not just the company that launched it. That's a classic case of privatizing the benefit and socializing the cost, exactly the pattern environmental law was designed to fix.

If a company knows it will have to pay for the debris it leaves behind, it has a real incentive to design satellites that can be safely deorbited, to plan missions more responsibly, and to invest in cleanup technology. Without that pressure, there's little reason for anyone to change their behaviour, because the cost of doing nothing falls on future users of space, not on today's launch companies.

Why It's Not So Simple

Applying an Earth based principle to space runs into some real obstacles.

First, there's the question of jurisdiction. Rivers and factories exist within a country's borders, so it's usually clear who's responsible for enforcing environmental rules. Space has no borders. A satellite launched by one country can create debris that threatens satellites belonging to a dozen other countries. Who has the authority to make anyone pay? The Cosmos Iridium collision mentioned earlier is a good example. It involved a Russian owned satellite and an American company's satellite, colliding in a shared orbit that no single country controls, and to this day neither side has paid the other for the loss.

Second, existing space law wasn't built with this problem in mind. The main international agreement, the Outer Space Treaty of 1967, was written when only a couple of countries could even reach orbit. It says states are responsible for their space activities and liable for damage their objects cause, but it says almost nothing about the slow, silent buildup of debris, or who's on the hook for a collision that happens decades after a satellite was abandoned.

Third, there's the tricky matter of proof. If two pieces of debris collide, tracing that debris back to the company or country that launched it can be difficult, especially with older objects and incomplete tracking records. You can't make a polluter pay if you can't prove who the polluter is.

Finally, space is now full of private players, companies launching thousands of satellites for internet service, imaging, and more. SpaceX's Starlink constellation alone has put over six thousand satellites into orbit in just a few years, and other companies are racing to launch their own mega constellations. These companies often operate across multiple countries, own subsidiaries in different jurisdictions, and can be hard to pin down legally. Making the principle work would mean building new international agreements that most spacefaring nations are willing to sign onto, which is never easy when national interests and commercial competition are involved.

What Accountability Could Look Like

None of these challenges are reasons to give up on the idea. They're reasons to build the right tools around it.

One option is orbital use fees, similar to a tax, charged to companies and countries for every satellite they put into orbit, with higher fees for satellites that don't have a clear deorbiting plan. Another is mandatory deorbiting rules, requiring satellites to be designed so they can be safely removed from orbit once their working life ends, either by burning up in the atmosphere or moving to a designated graveyard orbit. A dedicated cleanup fund, paid into by all spacefaring nations and companies in proportion to how much they launch, could finance active debris removal missions, several of which are already being tested by private companies and space agencies. And better tracking and attribution systems, using improved radar and tracking technology, would make it easier to identify whose debris caused a given problem, which is the foundation any "polluter pays" system needs to function.

Some of this is already starting to happen. The Federal Communications Commission in the United States introduced a rule requiring satellites in certain low orbits to deorbit within five years of finishing their mission, a sharp change from the old 25 year guideline. In fact, the FCC fined the American company Dish Network 150,000 dollars in 2023 for failing to properly deorbit one of its satellites, marking the first ever fine issued specifically for a space debris violation. The European Space Agency has also committed to a "zero debris" approach for its own future missions, and has funded a mission called Clear Space 1, designed to capture and remove a piece of leftover rocket debris from orbit. These are early, imperfect steps, but they show the direction is possible.

A Shared Sky, A Shared Responsibility

Space might feel infinite, but the useful parts of it, the orbits where satellites actually function, are a limited resource, much like clean air or clean water. We learned the hard way on Earth that leaving pollution unpriced leads to disaster. It would be a strange kind of failure to make the same mistake in orbit, especially when we can see the warning signs so clearly this time.

Extending Polluter Pays to space isn't about punishing exploration or innovation. It's about making sure the people who benefit from using space also carry the responsibility for keeping it usable, for themselves and for everyone who comes after them. The sky above us belongs to no one and everyone at once. Maybe it's time our laws started treating it that way.
